GUARANTEE BY BREEDER

 

1. Breeder guarantees that the cat listed above is a purebred Egyptian Mau, with an accurate pedigree, and is eligible for registration in either or both; Cat Fanciers Association (CFA) or The International Cat Association (TICA).

 

2. Breeder further guarantees that this animal is negative for FeLV and FIV at the time of leaving the cattery, and in good health. The cat has been vaccinated at least twice against feline upper respiratory diseases and free of internal parasites. And if purchased as a breeder is free from genetic defects.

 

There is no guarantee for kittens or cats when tested for Coronavirus as the test is not specific to a single Coronavirus.There is no guarantee if the buyer uses the FIP vaccine, as FIP may be potentiated by such.

 

3. If purchased as a PET this kitten is guaranteed for the first 3 years against a GENETIC problem so severe that it prevents the animal from living a normal life as a pet, i.e. HCM, Hip Dysplasia. Upon receiving written proof of a diagnoses of severe HD by an OFA or Penn Hip certification, or diagnosis of HCM by a certified Veterinary Cardiologist, the Buyer will receive a replacement with another kitten of equal quality as soon as available. Buyer may keep the original cat. Breeder is not responsible for any vet bills incurred. Buyer must provide a death certificate issued by a veterinarian in the event of a death in order to qualify for a replacement kitten..

 

4. If, during the initial veterinarian visit (with-in 48 hours of receipt), a diagnosis of disease other than stress-induced minor upper respiratory infection is made , Buyer agrees to provide a written report, signed by the examining licensed veterinarian, including the diagnosis and all test results the diagnosis is based on.

 

The Breeder has the right to request a second opinion from a Veterinarian of the Breeders choice, at the Breeders expense. Upon confirmation the Breeder is obligated to pay for the treatment of the diagnosed illness, up to 1/2 of the purchase price of the animal. The Buyer may, at his option and within five days of the veterinary diagnosis elect to either a)cancel this contract and be refunded the purchase price, or b) accept a replacement animal, when available. The Breeder may, at his option and within the same five day period, elect to cancel this contract and refund the purchase price to the Buyer. All costs associated with shipping will be the responsibility of the Buyer.

 

5. If Kittens sold as Breeder/Show prove to be sterile from congenital or hereditary conditions, the Breeder has the option of offering to the Buyer: a) upon altering of the original cat, replacement with the next available equal quality cat or kitten; or b) refund the difference between Breeder/Show and Show/Alter price. Show-Alter price is $***.**. (Sterility caused by an infectious agent is not covered by any guarantee.)

 

6. There is no refund or replacement given if this cat is successfully bred before having its Hips X- ray’d for hip dysplasia, with the results turning up positive through an OFA or Penn Hip reading. Or a positive HCM result from a Board Certified Veterinarian Cardiologist.

 

GUARANTEES BY BUYER

 

Please initial if in agreement,

 

____1.Buyer agrees to have the cat examined by their Veterinarian within 48 hrs of purchase, and advise the Breeder of the results of the exam. Mindful that the stress induced in an animal when going to a new home may cause symptoms of illness, including minor upper respiratory infection, to appear in otherwise healthy animals.

 

____2.Buyer promises and warrants that this cat will be an INDOOR animal, not allowed to roam freely outside. This animal WILL NOT BE DECLAWED, nor confined to a cage for extended periods of time.

____2a. Failure to comply with #2. will result in the voiding of any and all health guarantees on this cat.

 

____3.Under no circumstances will this cat ever be sold, leased, or given away to any pet shop, Humane Shelter, research facility or similar facility. If for any reason this cat cannot be kept by the Buyer, C.O. Maus Cattery will be notified PRIOR to any disposition being made of this cat.

 

____4.If at any time this cat is found to be ill, malnourished, abused, neglected, or loose unattended outdoors, Buyer will surrender said cat to the Breeder unconditionally, with no refund of purchase price.

 

____5.If this cat is purchased for breeding, Buyer warrants that it will be bred ONLY to another REGISTERED Egyptian Mau. Any offspring resulting from ANY mating to other than a registered purebred Egyptian Mau with breeding rights, shall not be eligible for registration, and shall be given away to good homes, and not sold as an Egyptian Mau.

 

____6. This cat will not be euthanised for any reason other than a veterinary deemed emergency.  without buyers contacting the breeder FIRST.

 

____7. This cat will not be sold or given away "intact" without the Breeders express written permission.

 

____8.If this Kitten or cat is sold to a multi-cat Breeder or Show home, the cat must be isolated for a period of 21 days in order for the health guarantee to be valid.

 

____9. All sales are final after 48 hours. Refund or replacement is at the Breeders discretion.

 

____10. Buyer agrees that this contract will be bound by the laws of the State of Oregon, and any dispute regarding this contract will be settled in Deschutes County Court.

MEDICAL: This cat has been vaccinated  Vaccines were given on :_______________ and _______________. Brand used: ____________________________________________.

 

It is recommended that a rabies vaccine be given between 6 & 8 months and your Vet may also want to vaccinate for Feline Leukemia Virus, but only if your cat is going to be in contact with any other at risk cats. Please DO NOT give multiple vaccines to your cat on the same day. Vaccinating for FIP is not recommended at this time.

 

CONDITIONS OF SALE:

BUYER(S) ACCEPT FULL RESPONSIBILITY FOR THE CARE OF THIS CAT/KITTEN.

BUYER(S) AGREE TO THE FOLLOWING TERMS:

~ Buyer(s) agree to maintain the proper veterinary care for the cat/kitten, including all yearly check-ups and vaccinations, as well as, provide proper grooming to keep the cat/kitten happy, matt free, and clean.

~Buyer(s) must also provide cat/kitten with proper food and clean water at all times.

~WITHOUT SELLER'S WRITTEN CONSENT this cat/kitten will not be given away or resold for any reason. No Exceptions!

~This cat/kitten must NEVER be given or sold to any research or testing facility, humane society, shelter, pet shop, or any organizations like it.

~In the event the buyer(s) can no longer care for this cat/kitten for any reason it is required that the cat/kitten be returned to the breeder if breeder agrees. No refund or compensations will be made to the buyer. If the breeder does agree to accept the cat/kitten back the cat/kitten must be examined and tested by a licensed veterinarian for the following: The cat/kitten must have a health certificate given with in the last week, tested negative for ringworm by having a culture taken and sent to a licensed lab, have been given a dose of revolution, a negative result for FELV/FIV, a negative fecal with no parasites found, and all medical records along with CFA papers will be transferred back to the breeder (ownership will automatically revert back to the breeder immediately if cat/kitten is returned for any reason). These test and precautions listed above are required to be done for the safety and health of my own cats and animals! Also all vet expenses will be the buyers responsibility including shipping the cat/kitten back if need be. If for any reason the breeder can not take back the cat/kitten for any reason we will be most helpful in finding the cat/kitten a new forever home!

~This cat/kitten will NEVER be allowed to roam freely outdoors.

~I highly recommend that this cat/kitten NOT be de-clawed. This is an amputation of the tips of the fingers and toes and is an inhumane procedure. My cats and kittens love their little paws just the way they are!

~If the buyer(s) violates this contract in ANY WAY, ownership of the cat/kitten will revert back to the seller, and the buyer will be required to return the cat/kitten at buyer(s) expense immediately.

 

 

 

SPAY AND NEUTER POLICY:

~ Any cats or kittens sold as pets MUST be spayed or neutered within three months from the date of pick up or by 6 months of age. The buyer(s) must prove with a copy of the invoice stating that the cat/kitten spay or neuter has been completed. The invoice must also state the Veterinarian's name, the licensed veterinarians name who preformed the spay/neuter, the breed, and the color of the cat/kitten. The buyer(s) agrees that this cat/kitten will NEVER be bred under any circumstances. If buyer(s) do not meet the requirements of the Spay and Neuter Policy, an additional payment of $5000 will be due immediately if valid confirmation of Spay/Neuter from a licensed veterinarian has not been received by the seller within the three month time period or by 6 months of age. No Exceptions! The seller will send the cat/kitten's CFA registration papers to the buyer within 30 days of receiving the receipts or invoices(listed above) to prove that the spay or neuter has been completed.

 

HEALTH AND GENETIC DEFECT GUARANTEE:

~Seller guarantees that this cat/kitten is in good health at time of sale. Buyer(s) must have the cat/kitten examined by a licensed veterinarian within 48 hours from pick up or date of delivery. A copy of the invoice of this examination must be sent to the seller. This cat/kitten is NOT to have ANY contact whatsoever with any other animal in the household until examined. If the cat/kitten is found to be ill with a life threatening disease, the buyer may return the cat/kitten within 48 hours for a kitten of equal value and color when a new kitten becomes available. Failure to have the cat/kitten examined by a licensed veterinarian within 48 hours, will negate this health guarantee and render this contract void. Any vet bills or debts on behalf of this cat/kitten is the sole responsibility of the buyer. No cash refunds for any reason. Seller does not guarantee against fleas, fungus, mites, or any type of parasites as these can be common in kittens and are also very treatable.  However, none of my cats or kittens would ever be sold with me knowing that they have fleas, fungus, mites or any type of parasites. Seller also believes this cat/kitten to be in perfect genetic health and will be replaced with another cat/kitten of equal value and color when available if it should die of a genetic defect within one year of date of birth, as long as the cat/kitten was examined within 48 hours from the date of sale by a licensed veterinarian as described in this contract, and a copy of the receipt of this examination was sent to the seller. Said genetic defect MUST be evident in a necropsy provided by the buyer.

~Administration of the FeLV or FIV vaccination will immediately render this contract void.

~Any disputes or claims shall be brought to the state of Oregon and reinstating of Venue will not be allowed in any other state other than Oregon. Also any disputes or claims will be held ONLY at the Deschutes County Court. Buyers will be responsible for all cost and legal fees for him or herself as well as the breeder (this includes for breach of contract).

 

~By the buyer(s) signing below, the buyer is stating that he or she has read, understands, and agrees with the conditions and terms within this contract. A $450 dollar deposit is required to hold any cat/kitten and is non-refundable if the buyer(s) decides, at any time, not to purchase this cat/kitten. Deposits are not transferable to any other kitten after the kitten turns 6 weeks old unless there is another available kitten in the same litter. The deposit amount will immediately be deducted from the balance due.
